    • The ekokom.cz website is operated by EKO‑KOM, a.s., registered office: Na Pankráci 1685/17, 140 21 Praha 4, registration number: 251 34 701, incorporated by entry in the Commercial Register kept by the Municipal Court in Prague, File B 4763 (hereinafter referred to as ‘EKO‑KOM, a.s.’ or ‘the Controller’).
    • This Policy is issued in accordance with legislation in force, including, but not limited to, with Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data (GDPR). The Controller hereby informs you about the processing of personal data and your rights.
  2. Scope of personal data processed on www.ekokom.cz
    • Since we keep the amount of personal data collected on our website to a minimum, we kindly ask you to cooperate by filling in only the required data as per information in the following paragraphs.

  1. Purpose(s), duration and method of personal data processing
    • With natural persons and natural persons engaged in business (hereinafter referred to as the ‘Data Subject’), the Company processes personal data for the purposes set out below, both manually in paper and electronic form and automatically. The Controller will not transmit personal data to any recipient in a third country or international organisation.

a)     Performance of a contract to which the Data Subject is a party (natural persons/self-employed persons)

During the term of the contract (Joint Performance Contract) and upon termination thereof for the period necessary to settle mutual rights and obligations, the Controller processes personal data to the extent specified in the contract on the basis of and for the purpose of performing the contract and for the purpose of fulfilling the obligations arising from binding legislation, including, but not limited to, Act No 477/2001 Sb., on packaging and amending certain acts, as amended, and Act No 563/1991 Sb., on accounting, as amended. The provision of personal data for such processing is mandatory. The contract cannot be concluded if personal data are not provided.

b)    Audit of performance under the Joint Performance Contract

Under the Joint Performance Contract, the Controller may engage auditors to conduct an audit. To this end, the Controller processes data contained in the Statement for a period of five years and upon expiry thereof for the period necessary to settle mutual rights and obligations. More detailed conditions related to auditing are set out in the Joint Performance Contract.

 c)     Sending of commercial communications (direct marketing)

The Controller may use your electronic address for the dissemination of commercial communications about the Controller’s products or services, or products/services that are similar to those provided to you by the Controller, in accordance with Section 7(3) of Act No 480/2004 Sb., on certain information society services, as amended. In these cases, the Controller may do so until you express your disagreement either by responding to our email containing a commercial communication or by emailing: gdpr@ekokom.cz.

d)    Handling of queries via the contact form

The personal data that you enter via the contact form is processed for seven working days so that the Controller’s authorised employees can provide a response to your enquiry, based on our legitimate interest. Once answered, the communication, including email, is archived for a maximum of one year for internal evaluation.

e)     Organisation of your attendance at conferences and seminars

Based on your application, the Controller will process your personal data under the conditions and to the extent specified in your application to attend a conference/seminar (apart from invoicing data) via its employees for the duration of the conference/seminar. The Controller will not disclose any of your personal data to third parties. The legal basis for the above processing is the dispatch of your binding application, on the basis of which a contract will be concluded for your attendance at the conference/seminar organised by the Controller. The Controller also advises you that you will be required to provide personal data in this application; if you do not provide such information, you will not be able to attend the conference/seminar.

f)    Contacting of clients to conduct surveys

Personal data to the extent of [company registration number, company name, first name, surname, address, telephone, email address and answers to questions asked] will be processed by the Controller through its processor for a period of five years in order to contact clients to survey them / determine their satisfaction with the take back and waste recovery system organised by the Controller, such being on the basis of a legitimate interest in determining the quality of the services offered. The results of the survey will be anonymised.

  1. Recipients of personal data
    • The Controller protects the personal data it processes through technical and organisational measures so as to prevent unauthorised or accidental access to the data or other misuse thereof. The Controller carefully selects business partners who process certain data on its behalf. These processors are bound by the obligation of confidentiality and may not use the data provided to them for any purposes other than those for which it is made available to them by the Controller. The current list of processors is always available at the Controller’s headquarters.
    • Where further required by law, the Controller is obliged to transfer certain personal data to public authorities (e.g. the Police of the Czech Republic or other authorities involved in criminal proceedings, etc.).
    • With the website, EKO‑KOM, a.s. uses the following recipient/processor for the processing of personal data: Jiří Najfus, registration number: 876 72 782, who is the website administrator and performs administrative and technical support in the operation of the website and supporting applications.
  2. Rights and obligations of Data Subjects
    • Data Subjects have the right of access to their personal data, the right to data portability and the right to object to processing. If users discover or believe that the Controller is processing personal data contrary to the protection of their private and personal life or contrary to applicable regulations governing the processing of personal data, in particular if the personal data is inaccurate with regard to the purpose of the processing thereof, the participant may ask the Controller for an explanation or request that the resulting situation be remedied. In particular, this may concern the rectification, supplementation, erasure of personal data or limitation of processing. Furthermore, users have the right to lodge a complaint with the Office for Personal Data Protection if they believe that the processing of their personal data violates applicable data protection legislation.     • If there is a change in the personal data of the Data Subject, the Data Subject will notify the Controller of the change without undue delay, no later than 14 calendar days from the date of the change.
