Authorised representative

for extended producer responsibility

 

Performance through an authorised representative is described in detail in Article XII of the General Terms and Conditions (GTC).

A foreign company that is not established in the Czech Republic is entitled to appoint an authorised representative for extended producer responsibility for packaging or packaged products that it supplies on the territory of the Czech Republic (Article 3(1)(20)).

An authorised representative may only be a person authorised to conduct business who is established in the Czech Republic and who has been designated by the customer as its authorised representative in a written contract.

The contract is concluded between the supplier (EKOKOM, a.s.), the customer (the producer) and the designated authorised representative. In such case, the Contract enters into force upon its execution by the contracting parties and the authorised representative. The authorised representative shall, pursuant to the contract, fulfil all obligations of the Customer stipulated by the contract. The customer and the authorised representative shall be jointly and severally liable for the proper fulfillment of the obligations under the contract.

Any notification or legal notice made by EKOKOM, a.s. to the Customer shall be deemed sufficient if it is made to the Authorised Representative.

 

Procedure for New Registration in the EKO‑KOM System
  1. Registration of the authorised representative – you can proceed with the registration of the foreign producer only after receiving the registration confirmation via email
  2. Registration of the foreign producer – requires a contract with the authorised representative
  3. EKO‑KOM sends the joint compliance contract with the authorised representative – addressed to the authorised representative
  4. Signing of the contract by all three parties
  5. Invoice for the annual fee (CZK 1,600 + 21% VAT) – the invoice is issued to the authorised representative and sent to their email address
  6. Upon payment of the annual fee, the Certificate of Participation in the system, along with the assigned EPR registration number of the producer, will be sent to the authorised representative

 

Notice:

If the producer you want to represent already has an existing Contract on Collective Compliance, you need to issue a new joint Contract on Collective Compliance with an authorized representative. Request its issuance by e-mail info@ekokom.cz.

The original Contract does not need to be terminated. After the settlement of mutual claims and liabilities, it will be replaced by a new Contract.

 

 

Packaging records, Invoicing and Audits

Authorised representative:

  • Receives a request to submit the quarterly packaging production statement (the statement) on behalf of the producer
  • Is reminded in the event that the statement is not submitted
  • Receives an invoice for the annual fee of CZK 1,600 with 21% VAT (the invoice is issued to the authorised representative – Art. XII, paragraphs 7 and 8 of the GTC)
  • Receives an invoice with 21% VAT for the submitted statement (the invoice is issued to the authorised representative – Art. XII, paragraphs 7 and 8 of the GTC).
  • Is reminded in the event of an outstanding invoice
  • In the case of an audit pursuant to Art. XXI, the authorised representative represents the producer

 

TIP: We enable collective payments for multiple producers

However, please strictly follow the procedure outlined below.

The payment information must be in the following order: variable symbol, amount, company name, total (see this file). Please read the information below and submit all future payments using this file.

The file is subsequently used for automated matching of received payments in our accounting system.

Please adhere to the instructions below:

  1. The file must be in .xlsx (.xls) format
  2. The worksheet must be named “TwistImport”
  3. The worksheet must contain two columns, which must be labeled in the first row as “VarSymbolUhrady” and “CastkaUhrady”
  4. Corresponding data must be entered in consecutive rows, without any blank rows between them
  5. The worksheet must end with the last row containing data; no cells below this row may contain any data.
  6. The sum of the amounts must equal the total bulk payment amount. This amount can be entered, for example, in the first row of an additional column, but it must not be placed at the end of the data column.
  7. Additional columns can be used for supplementary information.
  8. Do not use colors; borders may be used
