Where a Czech company sells directly to end-users in the EU (i.e. professional end-users or consumers), it is classified as producer in that country and must fulfil its obligations under Extended Producer Responsibility (Article 45 of the PPWR).

In all EU countries, the obligations regarding the take-back and recovery of packaging waste are the same, and compliance requirements are similar to those in the Czech Republic (an obligation arising from the aforementioned Article 45 of the PPWR).

Where a Czech company supplies goods to a distributor in an EU country (the distributor is not an end-user and supplies within the territory of a Member State), this obligation falls on the distributor.

Where a Czech company supplies goods to an end-user in an EU country (a consumer or a professional end-user – a company that uses the product for its business, e.g. as a raw material), this obligation lies with the Czech company in the relevant Member State to which the packaging is supplied.
